Marthinus Theunis Steyn


A dual-qualified lawyer (South Africa; Hong Kong), Marthinus specialises in dispute resolution. With a background in commercial litigation, Marthinus has extensive experience in insolvency and restructuring, general commercial disputes, trusts and tax.

Marthinus graduated with a BA LLB from Stellenbosch University, South Africa. He subsequently obtained an LLM in Tax Law from the University of Cape Town, South Africa.

After completing his training contract and one year as a litigation associate at a reputable Cape Town law firm, Marthinus moved to Hong Kong in 2019 to work as in-house legal counsel at a financial services firm. Marthinus was admitted as a Hong Kong solicitor upon passing the 2021 Overseas Lawyers Qualification Exams. Prior to joining JC Legal, Marthinus spent a year as an associate at one of Hong Kong’s leading contentious insolvency teams.

Notable Experience

  • Advised the creditors in the winding-up petition against a Hong Kong-listed company and successfully obtained a winding-up order.
  • Advised the trustees in bankruptcy of a Hong Kong businessman with creditors’ claims against the bankruptcy estate exceeding HK$500 million, with several cross-border elements.
  • Advised the liquidators in a cross-border insolvency matter involving a British Virgin Islands (“BVI”) company. This included drafting court papers to enforce a judgment obtained in the BVI with regards to a claim of HK$150 million, a mareva injunction application to prevent company assets being dissipated from Hong Kong, and an application for disclosure of information against a major Hong Kong bank.
  • Advised a high-net-worth South African family regarding the amendment of a trust deed which resulted in tax savings for the family business equivalent to HK$8 million.
  • Team leader on a restraint of trade case representing the largest e-commerce business in South Africa. Successfully restrained a former employee from joining the client’s largest competitor and divulging the client’s trade secrets.
